Necessary Symbiosis:  Strong Judicial Systems and Evolving Case Precedent Strengthen International Arbitration and Define a Desirable Seat

A well-established, functioning and ADR-knowledgeable judiciary is a necessary component in choosing the seat of an arbitration. This panel will explore the intersection of California’s state and federal courts and international arbitration which make California a desirable seat. Topics include: enforcement of arbitration agreements and awards, subpoenas, confidentiality, bankruptcy/insolvency, new case law, recent developments within specific sectors and future innovations to enhance the desirability of a seat for international arbitration.”

Speakers:

Dr. Kabir Duggal, FCIArb, is an attorney in Arnold and Porter’s New York office focusing on international investment arbitration, international commercial arbitration, and public international law matters, serving both as arbitrator and counsel.  Dr. Duggal is also a Lecturer-in-Law at Columbia Law School, an adjunct Professor at Fordham Law School and is a Course Director and Faculty Member for the Columbia Law School-Chartered Institute of Arbitrators Comprehensive Course on International Arbitration.    He also acts as a Consultant for the United Nations Office of the High Representative for Least Developed Countries, Landlocked Developing Countries and Small Island Developing States (UN-OHRLLS) on the creation of a novel “Investment Support Program.”  He has also conducted training and capacity-building sessions for several Governments including Colombia, Saudi Arabia, Myanmar, India, Philippines among others on public international law and dispute resolution matters. He also serves on the Federal Republic of Somalia’s New York Convention Task Force as well as the WTO Negotiating Team (International Board).  He has published over 40 articles and has spoken at over 300 arbitration events all over the world. He is also the Co-Founder of REAL (Racial Equality for Arbitration Lawyers), a non-profit seeking to create greater representation in international arbitration.  He is a graduate of the University of Mumbai, University of Oxford (DHL-Times of India Scholar), NYU School of Law (Hauser Global Scholar), Leiden Law School (2019 CEPANI Academic Prize), and is currently pursuing an SJD Degree from Harvard Law School. Dr. Duggal can be reached at kabir.duggal@columbia.edu.

Amb. (r.) David Huebner, C.Arb, FCIArb, is an international arbitrator and mediator who has handled more than 300 arbitrations in three dozen jurisdictions around the world.  He has particular expertise in the technology, life sciences, new energy, and media/entertainment sectors, and the Silicon Valley Arbitration & Mediation Center has regularly named him to its “Tech List” of the “world’s most accomplished technology neutrals.”  He sits on the panels of the principal international and regional commercial arbitration institutions and was appointed to the ICSID panel of investor-state arbitrators by President Obama.

A graduate of Princeton University (summa cum laude) and Yale Law School, Amb. Huebner is a licensed solicitor in England & Wales, member of the Bars of California, New York, and DC, Fellow of the College of Commercial Arbitrators, Chartered Arbitrator and Fellow of the Chartered Institute of Arbitrators, and life member of the Council on Foreign Relations.  He is a trustee of the Chartered Institute of Arbitrators, representing the Western Hemisphere.

United States Magistrate Judge Louise LaMothe, FCIArb, occupies a unique part-time judicial position in Santa Barbara for the Central District of California. She has served since 2014 and handles a wide variety of criminal duties as well as settlement conferences for the Court. She practiced as an arbitrator and mediator for many years in Santa Barbara before her appointment and continues her private ADR practice in areas that do not conflict with her official duties. A Stanford Law School graduate and Martindale AV-rated litigator in Los Angeles for more than 20 years, she serves on the American Arbitration Association’s commercial, employment, international, class action and large complex case panels She is a Fellow of the Chartered Institute of Arbitrators, the College of Commercial Arbitrators, and an International Mediation Institute-certified mediator. She is a former Chair of the ABA Section of Litigation, and an ALI life member. In 2020, California Women Lawyers named her its Distinguished Jurist of the Year. She has written and spoken throughout her career on gender equity and has been named one of California’s Top 50 California Neutrals and a California Super Lawyer. Katherine Smith Dedrick, FCIArb, is an experienced commercial litigator, arbitrator and the cofounder of a domestic and international disaster and insurance consulting company based in the US and Asia Pacific. She has handled hundreds of complex commercial matters throughout the US and in other countries including New Zealand, Australia and Chile. Katherine has argued before the Illinois Supreme Court, as well as numerous federal district and appellate courts and arbitration panels. She has significant arbitration experience both as a party representative and neutral. As a party representative, she was lead counsel on complex reinsurance and environmental contamination matters. As a neutral she has been a panel member in complex commercial financial disputes, and a sole arbitrator in property insurance, commercial business and consumer matters. Katherine is a neutral with the American Arbitration Association and FINRA, and a Fellow and Chair of the North American Branch of the Chartered Institute of Arbitrators. Katherine received an MBA from the University of Chicago Booth School of Business studying in the US, Spain and Singapore. She’s received the Business Insurance Women to Watch Award, the Mercedes Mentor Award, and the Women with Vision Award. She is the author of the 5-star award winning legal thriller series Deviant Agendas and Private Agendas and is currently working on the third book in the series.
